ATF Ends NFA Registration for Suppressors and SBRs: What Changed and What It Means in California
What changed
- ✓ Form 1 approval to make a suppressor, SBR, SBS or AOW
- ✓ Form 4 approval to transfer one
- ✓ Registration in the federal NFA registry
- ✓ The tax stamp wait
Applies to suppressors, short-barreled rifles, short-barreled shotguns and "any other weapons."
- ✓ Buying from a dealer still means a Form 4473 and background check
- ✓ Prohibited persons still cannot possess them
- ✓ Machine guns and destructive devices: full NFA rules and $200 tax
- ✓ SBRs and SBSs: ATF still requires an approved Form 20 before you cross state lines
- ✓ State law still applies
Another win: the "engaged in the business" rule is gone
In Texas v. ATF, a federal judge in the Northern District of Texas vacated ATF's 2024 "engaged in the business" rule, which had expanded who needed a federal firearms license to sell guns. Final judgment came on June 12, 2026, and an August 13, 2026 order refused to keep any part of it. The statute Congress passed in 2022 still applies: you need a license if you devote time and labor to dealing firearms to predominantly earn a profit.
State law still decides what you can own
| State group | Suppressors | What it means for you |
|---|---|---|
| California, Delaware, Hawaii, Illinois, Massachusetts, New Jersey, New York, Rhode Island, Washington D.C. | Banned for civilians | The federal change does nothing here. Possession is still a state crime. |
| About 15 states that tie legality to federal NFA compliance | Legal with NFA paperwork | Many dealers still require a completed Form 4. Check your state before buying. |
| Remaining states | Legal | Dealers can transfer with a 4473 and background check, often same day. |
California specifically
Legal rifle parts for California and every state
A 16" barrel, a muzzle brake and a fixed stock work for standard rifle builds nationwide. A flash hider is fine federally but counts as a feature on a California featureless rifle.

- The 2024 "engaged in the business" rule was vacated in Texas v. ATF.
