DUTYTAC Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DUTYTAC website, products, services, and training classes (together, the "Services"). By using this website or placing an order, you agree to these Terms, our Shipping Policy, and our Privacy Policy. If you do not agree, do not use this website.
1. Eligibility
By using this website, you represent and warrant that:
- You are at least 18 years of age (or older where a higher age is required by law for a particular product).
- You are legally able to enter into binding agreements.
- You are not prohibited by law from purchasing or possessing the products you order.
- You will comply with all applicable federal, state, and local laws regarding the purchase, possession, transport, and use of products sold by DUTYTAC.
DUTYTAC does not knowingly market or sell products to minors.
2. Products and Legal Compliance
DUTYTAC is an authorized dealer of firearm accessories, optics, lights, tactical equipment, and related products. DUTYTAC does not sell firearms, serialized firearm components (including stripped lowers), ammunition, reloading components, magazines with a capacity over 10 rounds, or items regulated under the National Firearms Act (NFA).
DUTYTAC operates in compliance with California law and applicable federal regulations. Laws vary by state, county, and city, and we do not guarantee that any product is legal where you live. You are solely responsible for knowing and following the laws that apply to you. We may refuse or cancel any order that we believe cannot be lawfully fulfilled.
3. Law Enforcement and Restricted Items
Some products are sold only to qualified law enforcement, military, or other authorized purchasers. We may require proof of eligibility (such as agency credentials or a department letter) before shipping these items, and we may cancel the order if eligibility cannot be verified.
4. California Compliance and Identity Verification
DUTYTAC complies with California law, including California Assembly Bill 1263 (AB 1263).
- California customers must complete our AB 1263 Verification Form before an order can be processed or shipped.
- You certify that all information you submit is true, accurate, and complete.
- Orders will not ship until verification is complete. We may cancel orders that fail or do not complete verification.
- California orders require an adult signature at delivery.
5. Orders, Pricing, and Payment
We accept Visa, Mastercard, and American Express through our secure checkout. All orders are subject to payment authorization, product availability, identity verification, and fraud screening. An order confirmation email means we received your order; it is not an acceptance of the order. We may review, delay, limit quantities on, or cancel any order at our discretion, including orders that appear fraudulent or that come from resellers.
We work to show accurate prices, descriptions, images, and availability, but errors can happen. Many products ship directly from our distribution partners, and stock levels and product details can change without notice. If a product is listed at an incorrect price or with incorrect information, or becomes unavailable, we may cancel the order and refund any amount charged, even after the order has been confirmed. Product images are for illustration and may differ slightly from the item received.
6. Shipping and Delivery
Shipping rates, processing times, and delivery details are described in our Shipping Policy, which is part of these Terms. We ship within the United States only. Title and risk of loss pass to you when your order is delivered to the carrier. Delivery dates are estimates and are not guaranteed.
You are responsible for providing a complete and accurate shipping address. Packages returned to us as undeliverable, refused, or unclaimed are subject to a 20% restocking fee plus original and return shipping costs.
7. Returns and Refunds
All sales are final. DUTYTAC does not accept returns or exchanges or issue refunds for any product, including drop-shipped, clearance, special-order, and final-sale items, unless approved in writing by DUTYTAC management.
Please review your order carefully before purchasing. If an item arrives damaged, defective, or incorrect, you must email us within 48 hours of delivery with your order number and photos of the item and packaging. Reports are reviewed case by case, and any resolution (replacement, repair, credit, or refund) is at DUTYTAC's discretion. Items that have been installed, mounted, fired, modified, or used are not eligible.
8. Warranty Disclaimer
Products may be covered by the manufacturer's warranty, and warranty claims must be made directly with the manufacturer. DUTYTAC does not provide its own warranty. To the fullest extent permitted by law, all products and Services are provided "as is" and "as available," and DUTYTAC disclaims all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Gunsmithing Services
Optic cut, porting, and other gunsmithing services are performed to the specifications you select. You are responsible for confirming that the service and the finished part are legal where you live and compatible with your firearm and optic. Turnaround times are estimates. Once work has begun, service orders cannot be cancelled or refunded. Machined parts cannot be returned to their original condition, and DUTYTAC is not responsible for pre-existing damage, normal finish variation, or any effect a modification has on a manufacturer's warranty.
10. Training Classes
All participants in DUTYTAC training must sign a liability waiver and follow all instructor and range safety rules. We may remove any participant who acts unsafely, without a refund. Class schedules, prices, and enrollment are subject to change, and class-specific terms (including scheduling and cancellation) are provided at registration.
11. Product Use, Installation, and Modification
Use all products according to the manufacturer's instructions and applicable laws. Firearm accessories and parts should be installed by a qualified gunsmith. DUTYTAC is not responsible for improper installation, misuse, or modification of any product, which may cause damage, serious injury, or death. You assume full responsibility for the safe and lawful use of all products and Services.
12. Chargebacks and Payment Disputes
You agree to contact us at support@dutytac.com about any billing issue or refund request before filing a dispute or chargeback with your card issuer. We will provide order, verification, shipping, and delivery records to your card issuer to contest any chargeback we believe is improper or inconsistent with these Terms. We may cancel pending orders and refuse future orders from customers who file improper chargebacks, and unpaid balances may be referred for collection as permitted by law.
13. Limitation of Liability
To the fullest extent permitted by law, DUTYTAC and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, property damage, or personal injury arising from the use or misuse of any product or Service. DUTYTAC's total liability for any claim relating to an order will not exceed the amount you paid for that order.
14. Indemnification
You agree to indemnify and hold harmless DUTYTAC and its owners, employees, and affiliates from any claims, losses, and expenses (including reasonable attorneys' fees) arising from your use or misuse of products or Services, your violation of any law, or your breach of these Terms.
15. Intellectual Property
All website content, including the DUTYTAC name and logo, text, graphics, and design, is owned by DUTYTAC and protected by law. Third-party trademarks and product images belong to their respective owners. Nothing on this site may be copied without our written permission.
16. Force Majeure
DUTYTAC is not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, supply chain or distributor disruptions, carrier delays, changes in law or government action, and internet or system outages.
17. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Orange County, California, and you consent to their jurisdiction.
18. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the policies referenced above, are the entire agreement between you and DUTYTAC regarding your use of the Services. We may update these Terms at any time by posting a new version on this page, and your continued use of the website after an update means you accept it.
