Return, Refund & Shipping Liability Policy
Effective Date: October 23, 2026
This Return, Refund & Shipping Liability Policy ("Policy") governs all purchases made through DUTYTAC.com (the "Site"), operated by Dutytac LLC, a California limited liability company ("Dutytac," "Company," "we," "us," or "our"). By placing an order through the Site, you ("Customer," "Purchaser," or "you") acknowledge that you have read, understood, and agree to be bound by this Policy, which is incorporated by reference into the Site's Terms of Service.
1. All Sales Final
1.1. ALL SALES ARE FINAL. Except as expressly provided in Section 5 (Damaged, Defective, or Nonconforming Goods), the Company does not accept returns, exchanges, or cancellations, and does not issue refunds or credits, for any order once it has been submitted, processed, or tendered to a carrier.
1.2. The Purchaser is solely responsible for confirming product specifications, compatibility, sizing, quantity, and suitability for the Purchaser's intended use before placing an order. Buyer's remorse, ordering errors, incompatibility, or a change of mind do not entitle the Purchaser to a return, exchange, or refund.
2. Fulfillment by Third-Party Distribution Partners
2.1. Most products sold through the Site are fulfilled and shipped directly by the Company's authorized third-party distribution partners ("Distribution Partners"). Orders may be sent to Distribution Partners for fulfillment immediately after they are placed.
2.2. As a result, the Company cannot guarantee that an order can be cancelled, changed, or redirected after submission. Any request to cancel or change an order may be granted or denied at the Company's sole discretion. A request is not effective until the Company confirms it in writing.
3. Shipping Information; Purchaser Responsibility
3.1. The Purchaser is solely responsible for providing a complete, accurate, and deliverable shipping address at checkout, including all apartment, suite, unit, building, and gate access information. Orders are shipped to the address exactly as the Purchaser entered it.
3.2. The Company is not liable for any order that is delayed, misdelivered, lost, or returned because the shipping address was incorrect, incomplete, insufficient, or undeliverable, whether the error was the Purchaser's or the carrier determined the address to be undeliverable.
3.3. Address changes requested after an order has been placed are not guaranteed, and any such change may incur additional fees.
4. Signature Requirements; Return to Sender
4.1. Signature Requirements. Certain products may require a direct or adult signature (21 years of age or older) upon delivery under manufacturer, carrier, regulatory, or Company requirements. The Purchaser is solely responsible for ensuring that an eligible person is available to sign for the shipment. Signature requirements are not waivable at the Purchaser's request.
4.2. Return-to-Sender Events. A "Return-to-Sender Event" means any shipment that the carrier returns to the Company or a Distribution Partner for any of the following reasons:
- (a) the shipping address was incorrect, incomplete, insufficient, or undeliverable;
- (b) no signature was obtained, or no eligible adult was available to sign, after the carrier's delivery attempts;
- (c) the Purchaser or any person at the delivery address refused delivery;
- (d) the shipment was not claimed or picked up from the carrier's facility within the carrier's holding period;
- (e) the carrier could not access the delivery location (for example, gated communities, secured buildings, or restricted-access properties); or
- (f) any other reason not caused by the gross negligence of the Company.
4.3. NO LIABILITY. THE COMPANY IS NOT LIABLE FOR ANY RETURN-TO-SENDER EVENT, OR FOR ANY LOSS, DELAY, OR DAMAGE THAT RESULTS FROM ONE.
4.4. Restocking Fee and Deductions. If a Return-to-Sender Event occurs and the Company or its Distribution Partner recovers the product in resalable condition, the Company may, at its sole discretion, either:
- (a) reship the order after the Purchaser pays all new shipping and handling charges in advance; or
- (b) issue a refund or store credit for the purchase price, less: (i) a restocking fee equal to twenty percent (20%) of the product purchase price; (ii) all original outbound shipping and handling charges; (iii) all return shipping charges, carrier surcharges, and address-correction fees; and (iv) any payment processing fees the Company incurred that are not recoverable.
4.5. Forfeiture. The Purchaser forfeits the order and is not entitled to any refund, credit, or reshipment if the Purchaser does not respond promptly to the Company's notice of a Return-to-Sender Event, if the Company or its Distribution Partner does not recover the product, or if the product comes back damaged, used, or not in resalable condition. The Company decides whether a response was timely at its sole discretion.
5. Damaged, Defective, or Nonconforming Goods
5.1. If a product arrives physically damaged in transit, or materially differs from what was ordered, the Purchaser must notify the Company in writing at support@dutytac.com promptly upon delivery. The notice must include the order number, a description of the issue, and clear photographs of the product, its packaging, and the shipping label.
5.2. The Company decides, at its sole discretion, whether a claim was submitted promptly and properly. Claims the Company determines were not are waived.
5.3. The Company will review each claim with the applicable Distribution Partner and will decide, at its sole discretion, whether to provide a replacement, a store credit, or a refund. The Purchaser may not return any product without a written return authorization from the Company. Unauthorized returns will be refused and will not be credited.
5.4. Manufacturer Warranties. Defects that appear after delivery are covered only by the applicable manufacturer's warranty, if any. All warranty claims must be made directly to the manufacturer. The Company makes no independent warranty on any product.
6. Lost or Stolen Packages
6.1. Risk of loss and title for all products pass to the Purchaser when the Company or its Distribution Partner delivers the shipment to the carrier.
6.2. The Company is not responsible for packages lost, stolen, or damaged after the carrier marks them as delivered. For shipments that appear lost in transit, the Company will reasonably assist the Purchaser in filing a claim with the carrier. Any payment depends entirely on the carrier's decision.
7. Restricted Products and Legal Compliance
7.1. The Purchaser is solely responsible for knowing and complying with all federal, state, and local laws that apply to buying, owning, and possessing any product ordered.
7.2. The Company may cancel any order that it determines, at its sole discretion, cannot lawfully be shipped to the destination. In that case, the Company will refund the amount paid, minus any non-recoverable processing fees.
7.3. If a Purchaser gives false or misleading information to obtain a restricted product, the Company may cancel the order and keep the restocking fee and any charges described in Section 4.4.
8. Chargebacks and Payment Disputes
8.1. The Purchaser agrees to contact the Company at support@dutytac.com and allow a reasonable opportunity to resolve any dispute before filing a chargeback or payment dispute with a financial institution.
8.2. The Company will contest any chargeback filed on an order that was fulfilled under this Policy, including orders affected by a Return-to-Sender Event, and may submit this Policy, order records, IP and device data, and carrier tracking information as evidence.
8.3. The Company may refuse future orders from any Purchaser who files a chargeback found to be unwarranted, and may seek recovery of all associated fees and costs.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO ANY ORDER SHALL NOT EXCEED THE AMOUNT THE PURCHASER ACTUALLY PAID FOR THE PRODUCT AT ISSUE. IN NO EVENT SHALL THE COMPANY, ITS MEMBERS, EMPLOYEES, OR DISTRIBUTION PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
10. General Provisions
10.1. Modification. The Company may amend this Policy at any time by posting a revised version on the Site. The version in effect when an order is placed governs that order.
10.2. Severability. If any provision of this Policy is found invalid or unenforceable, the remaining provisions remain in full force and effect.
10.3. Governing Law. This Policy is governed by the laws of the State of California, without regard to its conflict-of-laws principles.
10.4. Statutory Rights. Nothing in this Policy limits any right the Purchaser may have under applicable law that cannot be waived by contract.
